The present terms and conditions regulate the acquisition of products offered on the website www.sklum.com, the owner being Sklum Home and Deco SL (formerly Indecemi SL) (From hereafter, Sklum).
The acquisition of any of these products leads to the complete acceptance of each and every one of the present Conditions, with no repercussions on the acceptance of any particular Conditions which could be applied on certain products.
These Terms and Conditions may be modified without any prior notice; therefore it is recommended that you carefully read these contents before proceeding to acquire any of the offered products.

All notifications and communications between users and Sklum will be considered effective, for all purposes, when they are made by any of the means listed above.

IMPORTANT: Requests for amendments, made by e-mail, internal message, etc., will not be taken into account.
The products offered, together with their main characteristics and price, are displayed on the screen.
Sklum reserves the right to decide, at any time, the products and/or services offered to the Clients. Thus, Sklum may, at any time, add new products and/or services to those currently offered. Likewise, SKLUM reserves the right to withdraw or stop offering, at any time and without prior notice, any of the products offered.
All this without prejudice to the fact that the acquisition of any of the products can only be made by means of the subscription or registration of the USER, with Sklum providing the interested party with a user name and password, which will identify and personally enable him/her to access the products.
Once inside www.sklum.com, and in order to access the contracting of the different products, the USER must follow all the instructions indicated in the purchase process, which will imply the reading and acceptance of all the general and particular conditions established in www.sklum.com.
OBSERVATIONS
The offers presented by Sklum are valid within the limit of available stock. Sklum reserves the right to modify the range of its products according to the conditions imposed by its suppliers.
The purchased product may be subject to, due to the availability of the manufacturer, non-substantial modifications in the components, characteristics or performance of the lot of which it came from, provided that they do not imply a decrease in the qualities and performance advertised. Furthermore, this information may contain inaccuracies or typographical errors, which may be changed, corrected or deleted at any time. Sklum may make changes or modifications to the products at any time. THE IMAGES PUBLISHED ARE MERELY ILLUSTRATIVE.
WARNING
The consumer must, in any case, and before making the purchase of an article from those offered, ensure that it is suitable for the use the consumer wants to give it.
The customer is responsible for following and respecting the indications and safety recommendations mentioned below.
Sklum recommends fixing and/or securing the furniture to prevent possible damage as serious or fatal injuries can occur if a piece of furniture tips over. To prevent it from tipping over, it must be permanently fixed to the wall with the necessary fixing devices and fittings depending on the type of wall.
Certain precautions must be observed even after installation:
Sklum will not be held responsible for any injury, damage or damage caused by not following the above recommendations.
Regarding hammocks, sun loungers and similar items, to ensure their stability, Sklum recommends that you tighten the screws at least once a year.
Before each use, make sure that the assembly is correct, that the screws are properly tightened and that the article is in perfect condition for optimum useand thus avoid possible damage due to falls or trapped fingers.
Sklum intends to guarantee the availability of all products that are advertised through www.sklum.com. However, in the event that any product ordered is not available or if the product is out of stock, the customer will be informed within 24/48 hours of placing the order. In the event that the product is not in stock at the time of placing the order, the user will have the possibility of RESERVING said product, so that it can be provided as soon as possible.
If the product is not available, and the consumer has been informed of this, Sklum may supply a product of similar characteristics without price increase, in which case, the consumer may accept or reject it by exercising his right of withdrawal and termination of the contract.
In case of unavailability of all or part of the order, and the rejection of the replacement products by the customer, the refund previously paid will be made within 15 calendar days.
In order to make any purchase on www.sklum.com, it is necessary for the customer to be of legal age.
It will also be necessary for the customer to register at www.sklum.com by means of a data collection form in which he/she provides Sklum with the necessary information for the purchase; data that in any case will be truthful, accurate and complete about his/her identity and that the customer must expressly consent to by accepting Sklum's privacy policy.
It is also recommended that the customer prints and/or keeps a copy of the conditions of sale on a durable medium when placing an order, as well as the receipt sent by Sklum by e-mail.
To cancel an order, you must request the cancellation by logging into your customer area*, in order to give it the highest priority and to cancel the shipment of the order. This is the only way to block the shipment.

The customer agrees to receive the invoice in electronic format. The customer will receive the invoice in the MY ORDERS section of his user account.
The order will be delivered to the address designated by the customer at the time of contracting according to the method chosen.

Orders will be delivered to the customer via DHL courier or other parcel companies that carry out palletised deliveries. The order will be considered delivered when the carrier has delivered the package to the customer, and the customer signs the delivery receipt document. It is the customer's responsibility to check the condition of the packages (parcels/packaging) on receipt (giving a maximum of 48h.notice in your customer account area) and to indicate any anomalies on the delivery note (an essential condition, otherwise no claim for transport breakage will be accepted).

As soon as the consumer takes possession of the goods, the risk of loss or damage is transferred to the customer. Therefore the following steps are important:
If when inspecting the goods, it is found that they do not correspond to the order or that they have been damaged during transport, you have the option to reject the goods by indicating your reservations explicitly on the delivery note (a mandatory condition for making any claim for breakage or damage during transport).
The estimated delivery time is 10/12 working days after dispatch (provided that all the products in the order are in stock), except for palletised orders (bulky orders), where delivery may take 15/20 working days. Orders will be dispatched to the customer within 7/10 working days from the confirmation of the sale or order. No shipments or deliveries will be made on weekends and public holidays.
IMPORTANT: The standard door-to-door service does not include the delivery and collection of the goods to the customer's home, which is the responsibility of the customer. It is possible that the delivery person may voluntarily assist in the delivery of the goods (this is completely voluntary for the delivery person and the transport company and is not the responsibility of Sklum).
Assembly is also not included.
The prices of the products listed on www.sklum.com/uk will be expressed in Pounds unless otherwise stated and will be guaranteed for the duration of their validity and whatever the destination of the order.
The final prices of all the products (and, where applicable, the final prices per unit of measurement, when obligatory) together with their characteristics, offers, discounts, etc., are reflected in each of the articles that appear in the catalogue of www.sklum.com.
Return costs: depending on the type of return, collection costs will be borne by the customer.
The prices of the products may vary at any time. In this case, the price to be applied will be the price in force on the date the order was placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before the customer formalises acceptance.

You can pay immediately through the SSL secure payment gateway of our Bank. If any refund or cancellation of the order is necessary, the amount will be reimbursed through the same payment card. Both personal and bank data will be protected with all the security measures established by the Organic Law of Data Protection 15/1999 and its Development Regulation with total confidentiality.
Sklum accepts payments with VISA, Verified by VISA, MasterCard and MasterCard SecureCode. The bank that issues the card must be located in Spanish territory. When placing the order, the customer will provide his/her card details, which will be stored directly in the 4B Gateway during the purchase process. Sklum does not store credit card information. For internal reasons of the Organisation, the collection process is carried out through Banco Santander, without this being of any consequence for the customer.
By cash deposit or bank transfer in favour of Sklum Home and Deco SL (formerly Indecemi SL), to the account number indicated in the order confirmation e-mail. The customer's name and order number must be indicated when making the transfer.
Orders that are not paid within 7/10 days of order confirmation will be automatically cancelled.
The payment of the order will be authorised through PayPal, but no money will be withdrawn until PayPal verifies that it is correct. To do this, it is essential to have a PayPal account.
According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days* without having to indicate the reason and without incurring any cost, except for those provided for in art. 107.2 and 108 of RD1/2007, of 16 November, which approves the text referred to in the General Law for the Defence of Consumers and Users.
* The withdrawal period is extended until 31/01/2025 for orders placed on or after 28/10/2024.
OBSERVATIONS
No product manipulated by the client in bad use, breakage, etc. will be changed or paid for; otherwise, all guarantee will be lost. In case of a defective product, the return costs will be charged to Sklum. In other cases, these will be assumed by the customer. If the cancellation of the order is communicated before the shipment of the order, the customer will be exempt from any expenses. In case of replacement of a product, it may not necessarily be the same as the previous one, but in any case an improved version or model, since the products are subject to continuous improvement. If the product is in good condition, but the packaging (box, plastic or wrapping) in which the product is found is not in good condition, the return will not be admitted; the same will happen if the product is not in good condition. Both the collection of the product and its return will be managed by Sklum through our courier service.

The client will have a maximum period of 14 calendar days from the day of receipt of the goods or product ordered to inform Sklum of their wish to withdraw from the contract.
The withdrawal implies that Sklum will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days from the reception of the return in our warehouse, following the same procedure chosen by the customer for its payment (except in case of cash on delivery).
During this period, the consumer will communicate to the entrepreneur his decision to withdraw from the contract by filling in the form at the end of this document and sending it to the email address of Sklum.
Sklum will send the consumer an acknowledgement of receipt of the withdrawal on a durable medium. In order to return a product, it is essential that it is in perfect condition and with all its accessories and without having been used and/or assembled*.
Once we receive your request we will contact the customer to indicate the details of the return. The customer will bear the cost of returning the goods.
* IMPORTANT: Products in the PERSONAL CARE category cannot be returned once their original packaging has been opened.
ATTENTION
Any product manipulated by the customer in case of misuse, breakage, etc. will not be exchanged or credited; otherwise, any guarantee will be forfeited. In case of defective product, the shipping costs will be borne by Sklum. In all other cases, these shall be borne by the customer. If the cancellation of the order is communicated prior to shipment, the customer shall be exempt from any costs. In case of replacement of a product, it may not necessarily be the same as the previous one, but in any case an improved version or model, since the products are subject to continuous improvement. Both the collection of the product and its return will be managed by Sklum through our courier service.

All products purchased on our online shop are covered by a 3-year guarantee for all orders placed from 01/01/2022. The start date of the guarantee is the date stated on the purchase invoice. The guarantee does not include deficiencies caused by negligence, impacts, improper use or manipulation other than those indicated in the user manual, incorrect installation not carried out by the authorisedtechnical servicewhen applicable, ormaterials subject to wear and tear due to normal use. Deterioration of the colour due to exposure of the product by sunlight or other sources of heat. If you purchased the products before 1 January 2022, the guarantee period is 2 years.

The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract rescinded, in accordance with the provisions of Chapter II Title IV Book II of the General Law for the Defence of Consumers and Users.
If the product does not conform to the contract, the consumer may choose between repair or replacement of the product, both free of charge for the consumer, which shall be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.
If, once the repair has been completed and the product has been delivered, it is still not in conformity with the contract, the consumer may demand its replacement, a price reduction or the termination of the contract.
Sklum may suspend, withdraw or cancel partially or totally the products not subject to contract at any time and without prior notice. The above provision shall not affect those products which are reserved for registered users or which are subject to prior contracting and which shall be governed by their specific conditions.

According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/.
The parties submit, at their choice, to the courts and tribunals of the user's domicile for the resolution of disputes and waive any other jurisdiction. The language used will be Spanish.
